PUBLIC SERVICE FRANCHISE – EPCOR WATER ARIZONA INC. Pursuant to A.R.S. §40-283, set a public hearing for Wednesday, December 12, 2018, to solicit comments and consider the application by EPCOR Water Arizona Inc., for a public service franchise to provide domestic water and waste water utility services to the residents of Anthem, Sun City Tierra Del Rio, NE Agua Fria, Sun City, Sun City West, Agua Fria, Luke 303 Wastewater, Russell Ranch, Verrado, Chaparral and Paradise Valley, residing in Maricopa County. Set a hearing for January 16, 2019 for Road File No. PAB-0076 to rule on the request to abandonment of a portion of the Patent easement as proposed by the owner of the property located at an unassigned address near Cloud Rd and Central Avenue and being identified as Assessor Parcel No. 211-53-052A. NOTICE of the hearing by certified mail shall be sent to the applicant and all abutting property owners no less than 60 days prior to the hearing date. In addition, a notice shall be posted in the area of the proposed abandonment no less than 60 days prior to the hearing date. NEW LANDOWNER AND LICENSOR UNDER LEASE L-7460 Approve an administrative change to Ground Lease Agreement L-7460 to recognize FCI Holdings, LLC, an Arizona limited liability company, as the new landowner and lessor for the county radio tower site located southeast of Table Mesa Road and Interstate 17. The County received formal notice on October 29, 2018, that FCI Holdings, LLC is the new landowner and lessor via Assignment of Ground Lease Agreement. All rent payments and notices required under the lease shall be sent to FCI Holdings, LLC, Attn: Mr. Mike Fann, P.O. Box 4359, Prescott, AZ 86302.
Approve Intergovernmental Agreement between the United States Geological Survey and the Flood Control District of Maricopa County (District), for the period of October 1, 2018 to September 30, 2019, for collection of stream flow data on local watersheds throughout Maricopa County. The total cost of the IGA is $355,360. The District’s costs under this agreement will be $209,580, with the USGS contributing the remaining $145,780. Payments from the District are to be made quarterly. The agreement covers costs associated with the maintenance, collection, and publication of stream flow data and river reach characteristics at 9 continuous stream flow monitoring stations and 22 peak flow monitoring sites throughout Maricopa County. This agreement further will develop and evaluate long-term flood histories on watercourses in Maricopa County, and provide information critical to the determination of the risk of flooding in these watercourses. The information generated by the USGS’s ongoing work is vital to the safety of Maricopa County residents, and to the continuing hydrologic studies performed by the District. This agenda item impacts all Supervisorial Districts.
BA2018071 Kaliski Property. Applicant/Owner: Richard Ottens / Jason Kaliski. Location: 36218 N. 30th Dr. – 31st Ave. & Cloud Rd. Requests: Variance to permit: 1) Proposed front setback (west property line) of 6.66’ where 40’ is the minimum permitted and; 2) Proposed second driveway when only one is permitted on street frontage. Status: NR/DHCA reviewed and recommended a way to meet the need without a variance. County Staff recommended denial reporting that the request does not meet the statutory tests required for the granting of a variance. Final: By a vote of 4-0, the Board of Adjustment Approved subject to conditions ‘a’ – ‘d’. Condition a, b, and d were standard verbiage but “d” was unique to the case - the new driveway connecting to Cloud Road will need to be paved according to the MCDOT Residential Driveway requirements, and will require an application for work on the Right of Way.
